These Terms and Conditions govern the use of our website and the yacht charter brokerage services facilitated by Ekmar Turizm Ticaret A.Ş. (“we”, “us”, “our”) acting strictly as an authorized broker and licensed Group A travel agency (TÜRSAB No: 2262). By making an inquiry or initiating a booking request through ekmaryachting.com, you agree to these terms.

1. Bookings & Inquiries

All inquiries and booking requests submitted through our website are subject to availability and owner approval. Ekmar Yachting acts exclusively as an intermediary broker facilitating arrangements between the charterer and the vessel’s legal owner. A charter is only officially confirmed once a formal charter agreement is executed between the charterer and the owner (or their authorized representative) and the required deposit has been successfully processed.

2. Payments & Deposits

Deposits and charter payments are structured in accordance with the individual vessel’s charter agreement. While Ekmar Yachting may facilitate the collection of funds on behalf of the vessel owner as part of our brokerage services, the ultimate financial obligations and terms are governed by the executed charter contract.

3. Cancellations & Changes

Cancellation and amendment conditions vary by yacht, owner policy, and season, and are explicitly set out in your individual charter agreement. We strongly recommend comprehensive travel insurance covering cancellation, delay, and personal belongings.

4. Itineraries & Weather

Routes and itineraries shown on this site are indicative only. The captain reserves the right to alter the itinerary for safety, weather, or operational reasons. Such modifications are determined independently by the vessel’s crew and do not constitute grounds for a refund from the broker.

5. Responsibilities of Guests

  • Provide accurate guest information, passenger manifests, and required travel documents.
  • Follow the reasonable instructions of the captain and crew at all times, particularly regarding safety and maritime regulations.
  • Respect the yacht, its equipment, and fellow guests.

6. Liability & Broker Role

Ekmar Yachting acts solely as a booking broker and travel agency. We do not own, operate, or control the vessels listed on this website. To the extent permitted by law, we assume no direct liability for the operation of the yacht, performance of the crew, personal injury, property damage, indirect or consequential losses, or events beyond our reasonable control (including weather, force majeure, or third-party service failures). Nothing in these terms limits liability that cannot be excluded by law under the jurisdiction of the Republic of Türkiye.

Content, specifications, and descriptions on this website are provided for general informational purposes based on details supplied by vessel owners and may change without notice. Images and media are illustrative.

8. Governing Law

These terms are governed by the laws of the Republic of Türkiye. Any disputes arising in connection with our brokerage services shall be subject to the competent courts of Marmaris, Muğla, Türkiye.
